Terms of Service

1. Service Description
truspot.io ("Truspot", "we", "us") provides on-site property inspection reports ("Reports"). A Report documents the observable condition of a rental property at the time of the scout's visit, based on a checklist of physical, technical, and environmental factors (e.g. Wi-Fi speed, noise level, furniture condition, building access).
Truspot is not a real estate agent, rental broker, property manager, or guarantor of any rental outcome. We do not negotiate rental agreements, act on behalf of landlords, or recommend specific properties for rent.
Scouts engaged by Truspot are not certified experts, licensed property inspectors, surveyors, or publicly appointed appraisers ("öffentlich bestellte und vereidigte Sachverständige"). They are trained, independent individuals who conduct visual inspections and document observable conditions using standardized checklists and consumer-grade measurement tools. Reports do not constitute expert opinions (Gutachten) within the meaning of applicable law and are not intended to replace professional structural, legal, or technical assessments.
2. No Rental Guarantee
Reports are provided for informational purposes only. Truspot makes no representation or warranty that a property is suitable, safe, or appropriate for any particular purpose or person.
The decision to rent or not to rent a property remains solely with the client. Truspot is not liable for any rental decision, rental agreement, financial loss, or personal harm arising from or related to a Report.
3. Scope and Limitations of the Report
- The scout visits the property once, at a time coordinated with the landlord or listing contact.
- The Report reflects conditions observable at that specific time. Property conditions may change after the visit.
- Truspot cannot inspect areas not accessible during the visit (e.g. locked rooms, underground infrastructure, legal title, or building permits).
- Internet speed tests and noise level readings are instantaneous measurements taken during the visit. Long-term performance is not guaranteed.
- Photo and video documentation is included as part of the Report and reflects the state of the property at the time of the visit.
- Truspot does not verify the legal ownership of a property or the legitimacy of a rental listing.
4. Order Process and Payment
Submitting a request via our order form does not constitute a binding contract. Truspot will confirm scout availability before any payment is requested.
- Payment is due only after Truspot confirms scout availability for the requested property and timeframe.
- Payment is processed via Stripe. Truspot does not store payment card data.
- Prices are denominated in USD. The applicable price is the one displayed at the time of order confirmation.
5. Cancellation and Refunds
- Scout not available: If Truspot cannot source a scout for the requested property within the agreed timeframe, a full refund will be issued.
- Client cancellation before scout visit: A 50% refund applies if the client cancels after payment but before the scout visit has taken place.
- After the scout visit: No refund is available once the scout visit has taken place, regardless of the client's satisfaction with the property or the Report.
5a. Right of Withdrawal
Consumers residing in the European Union have the right to withdraw from a distance contract within 14 days without giving any reason (right of withdrawal, § 312g BGB).
The right of withdrawal expires early — before the 14-day period — once Truspot has fully performed the service (i.e., once the scout visit has taken place), provided that:
- the client has expressly requested that performance begin before the 14-day withdrawal period has expired, and
- the client has acknowledged that the right of withdrawal is lost upon full performance of the service (§ 356 Abs. 4 BGB).
By confirming payment and requesting the scout visit to proceed, the client expressly agrees to these conditions. Truspot will provide a separate written confirmation of this consent at the time of payment.
Clients wishing to exercise their right of withdrawal before the scout visit has taken place may do so by contacting Truspot at hello@truspot.io or via WhatsApp. In this case, the cancellation and refund terms of §5 apply.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Truspot's total aggregate liability to any client for any claim arising from or related to a Report or these Terms is limited to the amount paid by the client for that specific Report.
Truspot is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Costs arising from renting an unsuitable property
- Relocation costs or temporary accommodation costs
- Lost income, lost data, or lost productivity
- Any harm resulting from conditions that changed after the scout visit
This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if Truspot has been advised of the possibility of such damages.
Notwithstanding the above, nothing in these Terms limits or excludes Truspot's liability for:
- death or personal injury caused by Truspot's negligence or that of its agents (§ 309 Nr. 7a BGB);
- damages caused by intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit) on the part of Truspot or its agents (§ 309 Nr. 7b BGB);
- any other liability that cannot be excluded or limited under applicable mandatory law, including mandatory consumer protection rights.
7. Use of the Report
Reports are provided for the personal use of the ordering client only. Clients may not resell, redistribute, or publish Reports without prior written consent from Truspot.
8. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict of law provisions. The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Siegen, Germany, to the extent permitted by law.
EU clients retain any mandatory consumer protection rights granted by the law of their country of residence.
9. Changes to These Terms
Truspot reserves the right to update these Terms at any time. The version in force at the time of an order confirmation applies to that specific order. Updated Terms apply only to orders placed after the date of publication.
10. Consumer Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR). Truspot is not willing and not obligated to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).
